Notice of Adopted changes to Association’s Rules
Dear Members of Corona Laurelwood Homeowners Association
September 21, 2020
At the duly noticed meeting of the Association’s Board of Directors (“Board”) held on September 15, 2020, the Board considered comments received in connection with the proposed changes to the Association’s Rules (“Proposed Election Rules”).
Proposed Election Rules
a. Purpose: Senate Bill 323 (“SB 323”) was recently signed into law. SB 323 makes several substantive modifications to the Civil Code’s provisions governing association elections, effective January 1, 2020. As a result, the Association must adopt Election Rules which will comply with the upcoming revisions to the California Civil Code.
b. Effect: If the Election Rules are approved, they will conform to new statutory requirements, limit the types of candidate qualifications an association may adopt, place limitations on who may serve as an inspector of elections, and bolster the ability of members to overturn an election that is not conducted in accordance with proper procedures.
This information and the language of the Proposed Election Rules were disclosed to the membership in advance of the Board meeting, in satisfaction of the rule-change procedures set forth in Civil Code section 4360.
After consideration of membership comments regarding the Proposed Election Rules, the Board voted to adopt the Proposed Election Rules and revise the Association’s Rules accordingly. The Election Rules are now in effect.
